New Jersey's Sales Tax Threshold Looks Standard — One Detail Isn't

October 3, 2026 1 min readBy Regulens Team

New Jersey uses one of the most familiar economic nexus structures in the country: $100,000 in revenue OR 200 separate transactions, either one alone sufficient to trigger nexus. For a seller who's already checked several other states with this same OR structure, it's tempting to treat New Jersey as a formality. The threshold is standard. What counts toward it is worth a closer look regardless.

The Threshold

Either $100,000 in gross revenue from New Jersey sales, or 200 separate transactions into the state within the measurement period, is enough to establish economic nexus on its own. Crossing both isn't required, and crossing just the transaction count, even with modest total revenue, is enough by itself.

Why the Transaction Count Shouldn't Be Dismissed

A seller with many small, low-value orders can cross New Jersey's 200-transaction threshold while remaining well under $100,000 in actual revenue from the state. This is precisely the scenario an OR-structured state is built to catch, and precisely the one a revenue-only mental model misses entirely. If your store sells lower-cost items in meaningful volume, transaction count deserves equal attention to revenue here, not an afterthought.

Marketplace Sales

As in most states with this threshold structure, marketplace-facilitated sales generally count toward the total even when the marketplace itself handles tax collection on that portion. Isolating only your direct Shopify sales when checking New Jersey specifically can understate your real position if you also sell through other channels.

What to Actually Check

Rather than treating New Jersey as a quick, standard check because the threshold looks familiar, it's worth confirming both your actual revenue AND your actual transaction count into the state specifically, since either one independently determines the outcome.
