Louisiana's Privacy Law Takes Effect in Under Four Months — Here's the Real Timeline

Louisiana's Data Privacy Act becomes enforceable on January 1, 2027. That sounds distant until you count the actual runway left: under four months from today. Compliance programs take real time to build, and Louisiana's threshold structure is different enough from its neighbors that assuming your existing multi-state program already covers it would be a mistake.

A Genuine Three-Way Trigger

Most comprehensive state privacy laws trigger on consumer count alone. Louisiana is a genuine exception: the law applies if your business meets $25,000,000 or more in annual revenue, OR processes data for 75,000 or more consumers, OR derives 50% or more of revenue from selling personal data. Any one of these three conditions alone is enough. This is a real, meaningful revenue-only path that most comparable states don't have.

Practically, this means a smaller-revenue store with substantial Louisiana consumer traffic could trigger this law through the consumer-count path even while safely under other states' revenue thresholds, and a larger, high-revenue store could trigger it purely on the revenue path even with modest Louisiana-specific consumer numbers.

Consumer Rights

Louisiana grants confirmation and access, correction, deletion, data portability, and opt-out of targeted advertising, sale, and profiling with significant effects. An appeals process is required for denied requests, a feature not every comparable state includes.

A Cure Period With an Expiration Date

Businesses get a 30-day window to fix a violation before facing enforcement, but this window itself is temporary. It runs only from the law's effective date through July 31, 2027, then disappears entirely. Any business planning to lean on this grace period should know it has a hard stop, not an indefinite lifespan.

Enforcement

The Louisiana Attorney General holds exclusive enforcement authority. Violations are treated as unfair or deceptive trade practices under the state's existing consumer protection law, though the private right of action normally available under that broader statute is specifically excluded here.

What to Actually Do With Four Months

If your store has any meaningful presence in Louisiana, this is the moment to check which of the three triggers might apply to you, not January. A compliance program built in the final weeks before an effective date is a materially worse position than one built with real runway.
